Terms of Use

Please read these Terms of Use carefully before downloading, installing, or using Scrieb. By downloading or using Scrieb, you agree to be bound by these Terms. If you do not agree, do not download or use the application.

Both entities are referred to collectively as "Licensor", "we", "us", or "our" in these Terms.

2. Scope of License

Licensor grants you a non-transferable, non-exclusive license to download, install, and use Scrieb on any Apple-branded devices that you own or control, subject to the Usage Rules set forth in Apple's App Store Terms of Service and these Terms.

3. Subscription and Payment

Access to Scrieb requires a paid subscription. Subscriptions are offered on the following terms:

Payments are processed by Stripe, Inc. We never store or access your payment card details. Your subscription activates upon successful payment confirmation from Stripe.

Subscriptions purchased through the Mac App Store are subject to Apple's billing and cancellation terms. Subscriptions purchased directly through scrieb.com are managed via Stripe; you may cancel at any time through the Stripe customer portal or by contacting us at alex@scrieb.com.

4. Right of Withdrawal (EU/EEA Users)

If you are a consumer located in the European Union or European Economic Area, you have the right to withdraw from this agreement within 14 days of purchase without giving any reason, provided you have not begun using the licensed content or services. To exercise the right of withdrawal, contact us at alex@scrieb.com before the 14-day period expires. By downloading and using Scrieb immediately, you expressly request that performance begin before the withdrawal period ends, and acknowledge that your right of withdrawal is thereby waived upon first use.

5. Audio Data and Privacy

Scrieb is a local-first application. All audio recording and transcription is performed entirely on your device using on-device machine learning models. Your audio files, transcripts, and recordings are never uploaded to our servers or any third-party cloud service. We have no access to your recordings.

We may collect limited technical data (such as app version and crash logs) to improve Scrieb, in accordance with our Privacy Policy. This data does not include any audio or transcription content.

6. Consent to Use of Diagnostic Data

You agree that Licensor may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — to facilitate the provision of software updates, product support, and other services related to Scrieb. Licensor may use this information to improve its products or to provide services or technologies to you, as long as it is in a form that does not personally identify you.

7. Third-Party Services

Scrieb may enable access to third-party services (such as export integrations). Use of such services is at your sole risk. Licensor is not responsible for examining or evaluating the content or accuracy of any third-party services and shall not be liable for any third-party materials or services. You agree to comply with the terms of any applicable third-party agreements when using those services.

8. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of Scrieb and destroy all copies, full or partial, of the application. Licensor may also terminate this license at any time, in which case any outstanding subscription fees paid for unused periods will be refunded on a pro-rata basis.

9. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCRIEB IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. LICENSOR EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT SCRIEB WILL MEET YOUR REQUIREMENTS, THAT OPERATION OF SCRIEB WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN SCRIEB WILL BE CORRECTED.

No oral or written information or advice given by Licensor or its representatives shall create a warranty. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

10. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE SCRIEB, HOWEVER CAUSED.

IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF FIFTY DOLLARS (USD $50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose. Some jurisdictions do not allow the limitation of liability for personal injury or incidental or consequential damages, so this limitation may not apply to you.

11. Export Controls

You may not use or otherwise export or re-export Scrieb except as authorized by the laws of Spain, the European Union, and the laws of the jurisdiction in which Scrieb was obtained. In particular, but without limitation, Scrieb may not be exported or re-exported into any country subject to EU or UN trade embargo, or to anyone on any applicable restricted-parties list. By using Scrieb, you represent and warrant that you are not located in any such country or on any such list.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Tarragona, Spain, except where applicable consumer protection law in your country of residence requires otherwise.

If you are an EU consumer, you may also submit a complaint via the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

If you downloaded Scrieb from the Apple Mac App Store, you acknowledge and agree that Scrieb is published on the App Store by Smart Technologies DOO, and:

We reserve the right to update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Continued use of Scrieb after changes constitutes acceptance of the revised Terms. For material changes, we will notify you via the email address associated with your subscription.
